Sexual Assault


The 2007-2008 Students’ Rights and Responsibilities Handbook outlines prohibited conduct. Included in this list of prohibited conduct is the following:

19. Sexual Battery or Rape. Committing any act of sexual battery or rape as defined by state law

31. Sexual Misconduct. Sexual misconduct may include any sexual act or penetration which is accompanied by threat, coercion, use of restraint or force, or any act where respondent knows, or should have known, that the victim was unable or incapable of giving consent.

Any student who has experienced a sexual assault or an attempted assault is well aware of the trauma associated with such an act. Students should be aware that any sexual intercourse without the consent of their partner is rape. Further, sexual intercourse with a partner who is unconscious or unable to consent for any reason is rape.

Complaints of alleged sexual assault should be lodged with the Office of the Assistant Dean of Student Life located in Keathley University Center, Room 326S. MTSU will investigate all reported sexual assaults or attempted assaults and, where appropriate, will hold disciplinary hearings to adjudicate these assaults according to the procedures outlined elsewhere on this website. Both the respondent and the complainant are entitled to the same opportunities to have others present during a disciplinary hearing. Any student found responsible for a sexual assault shall be appropriately sanctioned. A range of sanctions up to and including suspension or expulsion from the University are possible depending upon individual circumstances. Both the accuser and the accused shall be informed of the outcome of any on-campus disciplinary proceeding alleging a sexual assault.

Victims of sexual assault should recognize the importance of obtaining and/or receiving help in dealing with the crime. Existing counseling, mental health, or student services for victims of sexual assault include:

  • Crisis/Pregnancy Support Center, 893-0228
  • Rape Crisis Line, 327-1110
  • Rutherford County Guidance Center, 893-0770
