857 Worker’s Compensation and Tort Claims

I. Purpose
Middle Tennessee State University (MTSU or University) is an agency of the State, and, as such, is bound by state laws governing the claims of its employees due to their on-the-job death or injury, and claims against the state arising from the negligence of its employees. The Tennessee State Board of Claims and the Tennessee Division of Claims and Risk Management have been established to provide for the filing, investigation, hearing, and disposition of claims against the State. This policy outlines the process for filing claims.
II. Procedures for Filing Claims
- On the Job Death or Injury Claims. Employees desiring to file claims for injury or death suffered in the scope of his/her employment should contact the Office of Human Resource Services (HRS). HRS will supply the concerned individuals with the directions for filing the aforementioned claim. Employees, per this policy, are defined as any person being paid through MTSU payroll, including student workers, and any volunteer, properly registered as such, with the Board of Claims.
- Claims Arising from Negligence of MTSU Employees. Persons, who have been injured or suffered property damage as a result of the negligence of an MTSU employee, including any volunteer properly registered as such with the Board of Claims, who desire to file a claim against MTSU, should submit a claim on the Division of Claims and Risk Management online portal. Persons with questions about the claim submission process may contact the Office of the University Counsel.
No claim provided for under this section may be considered by the Board of Claims or the Division of Claims and Risk Management which has not been presented to it by sworn petition duly filed within one (1) year from the date on which the claim first accrued.
